RULES OF USE AND OPERATION OF THE SERVICE BY THE USER
The following sets out the rules governing the use and operation of the “Online Consultation” service, referred to generically as the Service.
Please note that queries will be selected by verifying that they contain all the elements necessary to formulate a medical opinion, and will then be submitted to the physician without any personal identification data (first and last name), identifying details, or email addresses, in order to minimise the processing of such data. The response will then be sent to the applicant by J|medical. Only queries that contain the elements necessary to allow an assessment of the pathological conditions described will be submitted to the physician.
Please note that this service is in no way intended to replace the direct relationship with a physician.
For this reason also, the Service will not under any circumstances provide:
– Urgent responses or requests for assistance
– Personalised plans
– Diagnoses of any kind (as no diagnosis is possible in the absence of a thorough medical examination)
– Judgements or assessments of the work of other physicians
– Guidance on initiating a pharmacological therapy, or on modifying an ongoing treatment
– Referrals to professionals or public or private facilities.
The right to use the Service is strictly personal to the user, and it is therefore not possible to submit queries relating to the pathological conditions of third parties, including family members and close relatives. It is understood that the user assumes full responsibility for their use of the Service. Users must be of legal age to access the service.
The user, under their sole responsibility, agrees to use the Service exclusively for lawful purposes, avoiding any improper use, being aware that failure to comply with this commitment may render them subject to civil and/or criminal liability.
The user expressly warrants that all content entered into the Service, including but not limited to texts, photographs, and audio, does not infringe any copyright, trademarks, trade secrets, or other proprietary rights belonging to third parties.
The content generated by the Service is made available solely for the personal use of Service users. The user undertakes not to use for commercial purposes, or for any purposes not previously and expressly authorised, the content obtained through the Service — and therefore, for example, not to publish, retransmit, distribute, publicly perform, reproduce, or record it on any type of medium.
The user also undertakes not to destroy, modify, or interfere in any way with any software, hardware, and/or servers of the Service or its associates, and not to prevent or interfere with third parties’ use of the Service. The user furthermore agrees not to alter or interfere with any information or material of the Service or associated with it.
J|medical reserves the right to suspend access to the Service at any time and without notice, following non-compliance with these rules, or in the event of any other breach of the terms of use of the Service, as well as any violation by the user of laws, regulations of any other nature, or judicial decisions.
Use of materials and information provided by the user

Indemnity
The user undertakes to hold J|medical harmless from any claims or demands by third parties and any related prejudicial consequences (including the payment of legal costs) that may arise from their access to the Service and/or their use of the Service in a manner not consistent with the rules set out herein.
Amendments and cancellations
J|medical reserves the right (without, however, assuming any commitment in this regard) to review, adapt, move, or delete any material uploaded or made available within the Service, at its sole discretion, including without notice.
Limitation of liability
The Service is provided in its current state of fact and law: we therefore exclude any warranty, express or implied, relating to the quality or particular characteristics of the Service, and we will not in any case be liable should the Service become unavailable, in whole or in part, or for any other manner in which the Service is rendered.
Continuous, uninterrupted, or secure access to the Service is not guaranteed, as the operation of the Site may be affected by numerous factors beyond our control.
J|medical therefore reserves the right to suspend the Service or permanently discontinue it for any reason.
To the extent permitted by applicable law, the user expressly waives the right to raise any objection, claim, request, action, or demand against J|medical and its employees, directors, collaborators, etc. in connection with their use of the Service or any other act or event related to the Service.
Any contact, including of a commercial nature, between the user and a third party — including advertisers and/or others with whom the user may come into contact in connection with or through the Service — shall not concern, bind, or affect J|medical, nor shall it have any effect other than in the user’s relations with such third parties. The user therefore expressly waives in advance the right to raise any objection, claim, request, action, or demand against J|medical (and/or its partner companies, and their respective employees, directors, collaborators, etc.) on such grounds.
Additional applicable conditions
J|medical reserves the right to require the user to accept, from time to time, additional terms of use applicable to specific parts or sections of the Service. Such additional terms will be incorporated into the relevant parts of the Service and will be clearly identifiable.
INFORMATION ON THE PROCESSING OF PERSONAL DATA
The following describes the methods of management and processing of users’ personal data collected through the website www.jmedical.eu by those making use of the “Online Consultation” service.
Anyone submitting a request to access the “Online Consultation” service is required to read this data processing information carefully, provided pursuant to Art. 13 of EU Regulation 2016/679 of 27 April 2016. This information is provided to those who make use of the web services accessible through the website www.jmedical.eu. By using the site, you accept the terms described in the Privacy Policy. If you do not agree with any of the terms and conditions set out in the Privacy Policy, you are invited not to use the website www.jmedical.eu. Users who have not yet done so are also invited to consult the Cookie Policy which forms an integral part of this notice.
Data Controller
The data controller for personal data processed as a result of consultation of the site is J|medical s.r.l., with registered office in Turin, via Druento 153/56.
Location of data processing and external data processors
The processing operations connected to the web services offered, including the storage of data collected through the site, are carried out at the premises (computers/servers) of J|medical, within the European Economic Area, and are managed exclusively by personnel designated for such services by the company, expressly authorised to process data, duly instructed on the security measures to be adopted, and subject to the constant supervision of the Data Controller and/or the Data Processor, or by any parties assigned to occasional maintenance operations.
No data derived from the web service is communicated or disclosed, it being understood that J|medical may choose to engage external data processors, such as hosting companies. The user’s personal data may therefore be transferred to and stored by third-party specialists engaged by J|medical, who will process the data on behalf of J|medical and provide support in delivering the requested content and services. J|medical will require such third-party providers to protect the confidentiality of the user’s data and to adopt adequate technical and organisational measures to protect data from accidental or unlawful destruction, loss or alteration, unauthorised disclosure or misuse, or any other unlawful processing.
Types of data processed
a) Data voluntarily provided by the user
Completion of the form dedicated to requesting the service offered by J|medical results in J|medical acquiring the user’s personal data necessary to respond to requests, as well as any other personal data included in the communication, including data relating to health status.
Users of the site are invited, in their service requests and/or queries, not to send the names or other personal data — including those of third parties — that are not strictly necessary.
To this end, it should be noted that data provided by users to access the Service will be processed preliminarily by J|medical personnel to assess the adequacy and completeness of the request and, in accordance with the principle of data minimisation, to remove from the query any identifying and contact data that would allow the applicant to be identified before transmitting the request to the physician for review. J|medical will also be responsible for receiving the physician’s response and sending it to the applicant.
b) Browsing data
The computer systems and software procedures used to operate this website may acquire, in the course of their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols. This is information that is not collected in order to be associated with identified individuals, but which by its very nature could, through processing and association with data held by third parties, allow users to be identified. This category of data includes the IP addresses or domain names of the computers used by users connecting to the site, the URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (success, error, etc.), and other parameters relating to the user’s operating system and computing environment.

Purposes and methods of processing
Personal data voluntarily provided by users by completing the Service access form are used solely for the purpose of fulfilling the requested service (requests for opinions, specific information requests). Data are retained for the time necessary to respond to the individuals concerned and are deleted 30 days after the response has been provided. Should a query be deemed of general interest, the response may be published after removing any element that could allow the identification of the individual concerned.
Browsing data are used solely for the purpose of obtaining anonymous statistical information on the use of the site and for monitoring its correct operation, and are retained for the time strictly necessary to pursue the purposes for which the data were collected, in any case no longer than 72 months. The data may be used for the purpose of establishing liability in the event of hypothetical cybercrime against the site: save for this eventuality, data on web contacts are retained for no longer than is necessary for the purposes for which they were collected and subsequently processed, in any case no longer than 72 months.
Personal data provided will be processed in accordance with the principles of lawfulness, fairness, relevance, and non-excess.
For the purposes indicated, operations of collection, recording, storage, and modification of data may be carried out in paper, computerised, and electronic form, with logic strictly correlated to those purposes and, in any case, always in compliance with the regulatory provisions designed to ensure, among other things, the confidentiality and security of the data.
The processing of personal data is carried out using paper-based media and electronic tools (computer/telematic systems).
Specific security measures are observed to prevent data loss, unlawful or incorrect use, and unauthorised access.

The user has the right to request access to personal data processed by J|medical.
JJ|medical is required to provide a copy of the personal data processed free of charge, including by electronic means.
Right to rectification
The user has the right to rectification of inaccurate personal data concerning them, including the completion of incomplete personal data.
Right to erasure (right to be forgotten)
In certain circumstances, the user has the right to the erasure of personal data concerning them.
Right to restriction of processing
IIn certain circumstances, the user has the right to restrict J|medical’s processing of personal data concerning them.
Right to data portability
Where processing is based on consent and is carried out by automated means, the user has the right to receive personal data concerning them in a structured, commonly used, and machine-readable format. The user has the right to transmit such personal data to another data controller without hindrance from J|medical, where technically feasible.
Right to object
In certain circumstances, the user has the right to object at any time to J|medical’s processing of personal data concerning them. For example, if the user has requested to receive information from J|medical – such as newsletters, etc. — and no longer wishes to continue receiving such information, they may simply withdraw their consent to prevent the receipt of further communications.
Automated decision-making, including profiling,
In general, the user has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects or similarly significantly/adversely affects the user. The foregoing does not apply where, among other things, automated decision-making and profiling are necessary for the conclusion or performance of a contract between the user and J|medical. Where the processing of personal data is based on the user’s consent, the user may withdraw that consent at any time. The foregoing does not affect J|medical’s processing of the user’s personal data carried out prior to the withdrawal of consent.
Please note that at any time, the user has the right to obtain confirmation of the existence or otherwise of personal data concerning them, even if not yet recorded, and to have such data communicated in an intelligible form; to know the origin of the data, the purposes of processing, the details of the Data Controller, and the subjects or categories of subjects to whom personal data may be communicated or who may become aware of it.
The data subject has the right to obtain at any time the updating, rectification, or integration of data processed by the controller, the erasure or anonymisation where possible, as well as the exercise of all other rights provided for by EU Regulation 2016/679 of 27 April 2016.
